Order Procedure

Customers can order products from www.edituraboema.ro either online, using the Shopping Cart, or by e-mail, by phone or directly at the store. The order is considered valid only after edituraboema.ro confirms to the Customer by e-mail/telephone the possibility of honoring it.

The customer can cancel the order by e-mail preferably on the same day it was placed until 4 p.m. or by phone, during the time interval specified on the first page of the website. The order can no longer be canceled after the package delivery confirmation has been received by email.

Orders entered on the same day to the same destination by the same person, or from the same IP address, are automatically accumulated into a single order for which a single invoice/receipt is issued. Discount coupons or vouchers are applied only once to the cumulative order.

Orders that require delivery to the address indicated on the website will be picked up within 5 working days from the order confirmation date. After this period orders will be canceled automatically. Orders containing discount coupons/vouchers will only be picked up by the owner of the order based on the identity document.

Unilateral cancellation of the order can be done by the customer if edituraboema.ro delays the delivery, except in cases of force majeure, by a maximum of 7 working days beyond the deadline specified in the order confirmation. The unilateral denunciation must be made in writing and sent with confirmation of receipt, by confirmed e-mail, earlier than the moment of taking possession of the ordered products. In this case, if the payment has already been made by the customer, the money will be returned to him, within a maximum of 14 days from the moment of receiving the products not accepted by the customer, according to the payment option specified in the order form.

Some orders require the customer's agreement for terms of delivery, payment, etc. The holders of these orders will be contacted by edituraboema.ro by phone or email. If within 10 days the client has not sent any response, edituraboema.ro assumes the right to cancel the order.

Important: The products distributed on the site are listed in several databases. For this reason, in the event of errors or mistakes in updating the database, some products that are listed as being in stock may actually be out of stock. In this case, the customer will be contacted as soon as this aspect has been reported.

Payment for the ordered products can be made:

1. a) online with the card, in complete safety, at the time of formulating the order. Cards accepted for payment are those issued under the logos VISA (Classic and Electron) and MASTERCARD (including Maestro).
2. b) payment by OP/deposit into the account.
3. c) repay upon receipt of the order.

In some cases (high-value orders or products that are delivered by special order) Boen@ reserves the right to request an advance payment of up to 50% of the value of the products ordered, a payment that will not be returned in case of order cancellation.

In the event that payment is not made by the customer, the order will be considered canceled and will no longer be honored. In this case, edituraboema.ro will have the right to request the payment of compensation and/or will be able to refuse to honor other requests for orders from the respective customer.

Delivery methods

1. a) delivery by fast courier
2. b) electronic delivery for books in digital format

The courier's standard delivery hours are Monday to Saturday. If Saturday delivery is desired, this must be mentioned in the comments section. Saturday delivery is only available in certain cities designated by the courier, not nationwide.

Orders with delivery outside the country within the courier's area shown on the website are also accepted. The cost of delivery will be calculated according to the number of products ordered, their weight and the country to which the orders will be shipped. Most international deliveries are made via DHL courier service.

Returning products

Our desire is for you to be fully satisfied when you buy products from edituraboema.ro.

Boem@ will comply with the provisions of Emergency Ordinance no. 34/04.06.2014 regarding consumer rights in distance contracts, which gives the buyer (only under the conditions of the mentioned normative act) the right within 14 working days of receiving all the purchased products, without penalties and without invoking any reason, to return the purchased products, moreover, increasing the return term to 30 days. Return costs are borne by the consumer.

In the case of books, the customer can request the return of the unused product/products, in the condition in which they were received, only in the original undamaged, unopened packaging and together with the original documents of the respective order. If the product is defective, the customer may request the return of the product(s). In this case, he can replace the said product with an identical one or - if this is not possible - he can get back the amount paid for that product. All responsibility for such defects rests with the distributor.

The return of the products will be done at the customer's expense, at the rates applied by the delivery agent during the shipment, in the original packaging and only if they have not suffered damage.

Considering the legal provisions provided by GEO 34/2014 in art. 13 para. 1 in conjunction with para. 3, The Seller reserves the right to refund the value of the returned product within a maximum of 14 (fourteen) days from the date on which it received the product sold and its conformity could be verified, unless the professional offered to recover it himself the products. edituraboema.ro has the right, when it considers that the client's actions were malicious, to ask him for interest damages, under the conditions of the legislation in force. Also, edituraboema.ro reserves the right to subsequently refuse to honor other customer orders.

Important:

Returns, (regardless of the transport method chosen), will never be sent by the customer to Boem@ with cash on delivery.

Books in digital format (ebooks) cannot be returned under any conditions. The customer has the responsibility to check the compatibility of the electronic formats available on edituraboema.ro with the owned device, before ordering. Secure eBooks cannot be converted to other formats. edituraboema.ro cannot return, convert or make other formats available to the client than those existing on the site at the time of the transaction.

Copyright

The content of the edituraboema.ro website (including but not limited to images, texts, web graphic elements, scripts, graphic elements, logo as well as other data) is the property of edituraboema.ro and its partners and suppliers, being protected by copyright law and intellectual and industrial property laws. On these grounds, it is absolutely forbidden to use these elements without the written consent of Boem@.

edituraboema.ro reserves the right to check the way in which the products/works published under the BOEM@ brand are sold or the platforms used in this regard, so as to ensure that the condition of the products is not altered or modified, that the presentation of the products and implicitly, the presentation of the BOEM@ brand fully respects the rights conferred on it by the provisions of Law 84/1998. BOEM@ also reserves the right to verify compliance with copyright and by reference to the competitive/anti-competitive policies used by third parties, natural or legal, in the handling of BOEM@'s work/products.

All images and texts from www. edituraboema.ro are by way of example. In this sense, the products delivered in the order may be different from those presented online (cover, packaging, color, appearance, accessories, format, etc.). Also, edituraboema.ro will be able to modify the details available online at any time regarding the products and services offered. The images and descriptions of the products may contain errors or may be different from reality, edituraboema.ro is not responsible for such situations, but will try to resolve them as soon as they are reported.

In the event that edituraboema.ro is unable to deliver the order due to the customer's fault (whether it is not found at the mentioned address or cannot be contacted, etc.), the order will be canceled and the products will be returned to Boem@. For a new delivery, the customer will have to bear new delivery costs or other technical costs that are imposed.

If the customer has made the payment in advance and, through his fault, cannot receive the products within a maximum of 10 days from the moment of shipment, nor can he be contacted within 30 days, the order will be canceled, but the payment will not be able to be returned, constituting compensation from the customer.

Orders registered on www. edituraboema.ro on Fridays after 6 p.m. and on Saturdays or Sundays will be shipped on Monday.

Boem@ is not responsible for the content, quality or nature of book descriptions and comments posted by site visitors. Also, edituraboema.ro is not responsible for the content of the sites reached through links.

Sending emails or SMS / WhatsApp messages

Through the following activities: ordering, subscribing to the newsletter, sending a message on the contact page or sending e-mails or SMS / WhatsApp messages addressed to edituraboema.ro, it is considered that the user agrees to receive e-mails or periodic SMS/WhatsApp messages containing various information strictly related to edituraboema.ro. In this situation, the personal data will not be used for other purposes and, according to this contract, they can be modified or deleted from the edituraboema.ro database at the written request of the client.

Force majeure and applicable law

Both the client and edituraboema.ro will not be liable for non-performance of contractual obligations, if such non-performance is due to a force majeure event.

This contract is subject to Romanian law.

Rights

Boem@ has the right to deny access to certain customers and visitors, for a limited or unlimited period, without prior notification, in justified situations that require such measures.

Boem@ proposes that the products published under its brand can be purchased from the platforms owned by it or from those that respect the same principles as Boem@, or that do not use anti-competitive policies, so that the rights are not affected which he enjoys according to Law 84/1998. In the situation where such a violation of copyright is found among those provided by Law 84/1998, Bookzone.ro reserves the right to request its partner to remedy the situation, by this it can be understood, if necessary, even interruption of the commercialization of the works.

According to the requirements of Regulation (EU) 2016/679 OF THE EUROPEAN PARLIAMENT AND OF THE COUNCIL of April 27, 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC ( General regulation on data protection) and Law no. 506/2004 regarding the processing of personal data and the protection of private life in the electronic communications sector, the company EDITURA BOEMA SRL has the obligation to manage the personal data provided under safe conditions and only for the specified purposes: issuing the tax invoice, informing about the status of the order and shipping to the customer. Refusal to provide information leads to the impossibility of honoring the order.

For the accuracy of the information, the client is asked to communicate any changes made since the date of its registration in the database.

The removal from the database of a customer's personal data is done on the basis of his written request sent electronically. The definitive deletion of personal data from the database will be confirmed to the client.

The price/discount policy on the website is entirely established by edituraboema.ro, and the purchase price is the one displayed when the order is placed.

Product prices are those displayed for each individual product and are updated daily. In principle, discounts, reductions and promotions are not cumulative. For the calculation of the amount, the discount with the highest value is kept.

All promotions on the website are valid while stocks last.
